RIGHTS AND RESPONSIBILITIES OF THE ALLEY THEATRE AND
ALLEY TICKET HOLDERS
A ticket (“Ticket”) to any event at the Alley Theatre (the “Alley”) is a revocable license. The holder of a Ticket, on behalf of that holder and any minor accompanying the holder (individually and collectively, the “Holder”), agrees to all of the following terms. By using a Ticket and entering any portion of the property at 615 Texas Avenue, Houston, Texas (the “Alley premises”), including but not limited to the theater building, the Holder agrees to be bound by the terms of the license.
The Holder agrees not to transmit, distribute, or sell (or aid in transmitting, distributing, or selling) any description, account, picture, video, audio or other form of reproduction of the event or any surrounding activities (in whole or in part) for which a Ticket is issued (the “Event”), whether in electronic, paper, or other medium. A Ticket may not be used for any form of commercial or trade purposes, including, but not limited to, advertising, promotions, contests, or sweepstakes, without the express written consent of the Alley.
Breach of any of the terms of this license, failure to comply with the Alley’s rules, or the refunding to the Holder of the printed purchase price of a Ticket, shall automatically terminate any rights that the Holder may have by virtue of having acquired that Ticket, shall render illegal and unauthorized the Holder’s use of that Ticket for any purpose; and shall authorize the Alley to withdraw that Ticket, refuse admission to the Alley premises, or eject the Holder from the Alley premises. Breach of any to the terms of this license shall also subject the Holder to all legal remedies available to the Alley. Resale or attempted resale of a Ticket in violation of applicable law or for a price in excess of the printed purchase price of that Ticket is grounds for seizure of that Ticket or cancellation without refund or other compensation.
The Holder grants permission to the Alley (and its designees, licensees, and agents) to use the Holder’s image, likeness, actions, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication, or reproduction made of, or at, the Event in any medium or context for commercial or promotional purposes without further authorization or compensation.
The Holder of a ticket voluntarily assumes all risk and danger of personal injury (including death) and all hazards arising from, or related in any way to, the Event, whether occurring before, during, or after the Event and whether caused in whole or in part by negligence or otherwise. The Holder agrees that the Alley (and its agents, officers, directors, and employees) are not liable for any injuries resulting from such causes.
The Holder and Holder’s belongings may be searched on entry to the Alley premises, and the Holder consents to such searches and waives any related claims that might arise against the Alley (and its agents, officers, directors, and employees). If the Holder elects not to consent to these searches, the Holder will be denied entry onto the Alley premises. Any lost, stolen, or counterfeit Ticket, or a Ticket for resale at a price that is either unlawful or in excess of the printed purchase price of the Ticket, may not be honored. The Alley may refuse admission to, or eject, any Holder, without refund, who is deemed to be disorderly or who fails to comply the terms of this license or any and all security measures. EVENT DATES AND TIMES ARE SUBJECT TO CHANGE.
